Kirkify AI provides an AI-powered image generation and face swap platform. Users can upload images to generate new content using artificial intelligence models.
- Registration: To access certain features, you must register for an account. You agree to provide accurate, current, and complete information.
- Security: You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.
- Age Requirement: You must be at least 13 years old (or the minimum legal age in your country) to use the Service.
You are solely responsible for the content you upload, generate, or share via the Service. You agree NOT to use the Service to:
- Illegal Content: Upload or generate content that violates any applicable law or regulation, including child sexual abuse material (CSAM). We report all CSAM to the relevant authorities.
- Non-Consensual Sexual Content (NCII): Generate or disseminate deepfake pornography or non-consensual intimate imagery of real people.
- Harassment: Harass, abuse, or harm another person or group.
- Infringement: Infringe upon the intellectual property rights or privacy rights of others.
We reserve the right to ban any user who violates these policies and to delete any offending content without notice.
- Your Content: You retain ownership of the images you upload ("Input") and the images you generate ("Output"), subject to the terms of the underlying AI models (e.g., Replicate). You grant us a non-exclusive, worldwide license to host, store, and display your content solely for the purpose of providing the Service to you.
- Our Property: The Service, including its original content (excluding User Content), features, and functionality, are and will remain the exclusive property of Kirkify AI and its licensors.
- Pricing: Some parts of the Service are billed on a subscription or credit basis ("Paid Services"). You will be billed in advance on a recurring and periodic basis (such as monthly or annually) or on a one-time basis.
- Payment Processor: We use Stripe to process payments. We do not store your credit card details.
- Refund Policy: Due to the nature of digital goods and the immediate costs associated with AI processing, we generally do not offer refunds once credits have been used or a subscription period has started. However, if you believe you have been charged in error or experienced a technical failure, please contact support@kirkify.meme for a case-by-case review.
In no event shall Kirkify AI, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Service;
- Any conduct or content of any third party on the Service;
- Any content obtained from the Service; and
- Unauthorized access, use, or alteration of your transmissions or content.
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied. We do not guarantee that the AI-generated results will be accurate, reliable, or suitable for your specific needs.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Kirkify AI operates, without regard to its conflict of law provisions.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
